Sporting Goods, Toys Among New China List 4A Tariff Exclusions; Retroactive Refunds Available

The Office of the U.S. Trade Representative has announced 10 additional product exclusions from the additional 7.5% Section 301 tariffs on List 4A goods from China.  Excluded products include sporting goods, toys, and glassware.  According to international trade law firm Sandler, Travis & Rosenberg, it is likely that these will be the last List 4A exclusions.

The excluded products are reflected in one ten-digit subheadings and 9 specially prepared product descriptions, which cover 25 separate exclusion requests.  Exclusions are available for any product that meets the specified product description, regardless of whether the importer filed an exclusion request.  The scope of each inclusion is governed by the scope of the product descriptions set forth by the USTR, not by the product descriptions set out in any particular request for exclusion.

Exclusions for these products, which must be claimed using the new HTSUS subheading 9903.88.55, will be retroactive to September 1, 2019, the effective date of the $300 billion action, and will remain in effect until September 1, 2020.

Importers should apply for refunds of any duties paid on the excluded products since September 1, 2019 by filing a Post Summary Correction.  Post Summary Corrections may be filed 300 days after release or 15 days prior to liquidation, whichever occurs first.
