The Office of the U.S. Trade Representative has announced additional product exclusions from the additional 25% Section 301 tariffs on List 3 goods from China. Excluded products include leather mobile device covers, desk accessories, various fabrics, portable outdoor cookers, digital scales, wooden toddler beds, wooden fireplace mantels, wood flooring, office furniture parts, car polishing devices, fuel filters, steel jacks, AC motors, power supplies, electrical conductors, copper cable lugs, irrigation canal valves, and printed circuit board assemblies.
The excluded products are reflected in one 10-digit HTSUS subheading and 46 specially prepared product descriptions, which cover 61 separate exclusion requests. Exclusions for these products, which must be claimed using the new HTSUS subheading 9903.88.40, will apply as of September 24, 2018, the effective date of the $200 billion action, and will remain in effect until August 7, 2020. Exclusions are available for any product that meets the specified product description, regardless of whether the importer filed an exclusion request. The scope of each inclusion is governed by the scope of the product descriptions set forth by the USTR, not by the product descriptions set out in any particular request for exclusion.

Importers should apply for refunds of any duties paid on the excluded products since September 24, 2018 by filing a Post Summary Correction. Post Summary Corrections may be filed 300 days after release or 15 days prior to liquidation, whichever occurs first.
