The following proposed revocations and modifications of U.S. Customs and Border Protection rulings are included in the Nov. 29, 2017, Customs Bulletin and Decisions. Comments are due no later than Dec. 27.
Concealer and Bronzer Powders. CBP is proposing to classify concealer and bronzer powders as make-up powders under HTSUS 3304.91.00 (duty-free) rather than as make-up preparations under HTSUS 3304.99.5000 (duty-free). CBP explains that the subject powders are like those it has previously classified under HTSUS 3304.91.00 and are therefore not classified in the basket provision. Ruling NY J86656 would be modified to reflect this change.
Metal Step Stools. CBP is proposing to classify metal step stools as articles of aluminum under HTSUS 7616.99.51 (2.5 percent duty) or articles of iron or steel under HTSUS 7326.90.86 (2.9 percent duty) rather than as metal furniture under HTSUS 9403.20.0015 (duty-free). CBP explains that these items are not furniture because (a) they do not allow a person to sit or lie down or to store or display articles in a permanent fashion and (b) they are designed to serve as a household tool or as an appendage or extension of the user. Rulings NY 855972, NY R02622, NY N022949, NY N023940, NY N024279, and NY N042721 would be revoked to reflect this change.
Zirconium Oxide Powder. CBP is proposing to classify yttria stabilized zirconium oxide powder, which is used in high-temperature ceramic applications such as crucibles or furnace linings, as mixtures of inorganic compounds under HTSUS 3824.99.39 (duty-free) rather than as other chemical preparations under HTSUS 3824.90.9290 (5 percent duty). Ruling NY N251680 would be revoked to reflect this change.
Hair Snap Clips. CBP is proposing to classify metal hair snap clips as combs, hair-slides, and the like under HTSUS 9615.19.6000 (11 percent duty) rather than as hair pins under HTSUS 9615.90.3000 (5.1 percent duty). CBP explains that these items are similar to hair-slides because they both hold hair in place by means of clasps or prongs that open and close. Ruling NY N096966 would be modified to reflect this change.
