As we move into 2026, still reeling the chaos of 2025, we are awaiting the all-important Supreme Court IEEPA tariff ruling. This decision could come as early as next week or as late as mid-summer. While most signs point to a ruling sooner rather than later, there is no official timeframe. Whichever way the Court rules will set off a chain reaction, and OCEANAIR will be here to help our customers through the process and support importing into the future under the Supreme Court’s guidance.
Effective immediately, a 25% Section 232 tariff is in place on semiconductors and derivative products classified under HTS codes 8471.50, 8471.80, and 8473.30 from all countries of origin. The affected articles are “logic integrated circuits” or similar products meeting specific TPP ratings. This new tariff includes eight exclusions for products classified under the same HTS codes but not meeting the technical definitions, as well as exclusions for data center end users, replacement parts, research purposes, various manufacturing uses, and public sector applications. Application of this tariff will avoid the stacking of other Section 232 tariffs.
Importers are also on standby for a threatened 25% tariff on any country doing business with Iran, whose primary trading partner is China. While the threat called for immediate tariffs, there is no official notice at this time. Other countries that would be impacted by this tariff include Saudi Arabia, the UAE, Turkey, and India.
U.S. less-than-truckload (LTL) carriers are preparing for market changes in 2026, led by the spin-off of FedEx Freight, while hoping for a resurgence in industrial freight to help fill partially empty trailers and terminals. LTL pricing remains elevated, but a prolonged period of unsteady demand will likely put further rate increases and carrier expansion plans on hold.
