The Court of International Trade determined that, yes, U.S. Customs must refund IEEPA tariffs to importers. This follows the Supreme Court’s ruling that the IEEPA tariffs were an overreach by the White House. The order states that, for unliquidated entries specifically, either duties should not be due or the entries should be liquidated less the tariff. The order did not include terminology for already liquidated entries.

This announcement provides a boost of optimism that a recovery process may be coming soon. However, to date, U.S. Customs has not released a formal statement or process to execute refunds.
